Terms of Service

Welcome to SmartBJJ. The SmartBJJ application (the "App") is operated by Fine Apps LLC, a Virginia limited liability company ("Fine Apps LLC," "we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. Description of Service

SmartBJJ is a mobile application that provides AI-powered Brazilian Jiu-Jitsu training tools, including video analysis, personalized training plans, technique coaching via chat, and competition tracking. The App uses artificial intelligence to analyze your training videos and provide feedback on your technique.

2. Account Registration

To use the App, you must create an account using Apple Sign-In, Google Sign-In, or email and password. By selecting an authentication option and continuing, you agree to these Terms and acknowledge our Privacy Policy. You must be at least 13 years old. You are responsible for maintaining the security of your account and for all activities that occur under your account. You must provide accurate information during registration.

3. Subscriptions and Purchases

• The App offers subscription plans and consumable purchases (analysis credits) through Apple's In-App Purchase system.
• Subscription payments are processed by Apple. Prices are displayed in the App before purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription in your Apple ID account settings.
• Refunds are handled by Apple according to their refund policies.
• If you request a refund from Apple, we may send Apple a summary of what your purchase delivered to help Apple review the request. Apple makes the final decision. You can withdraw permission at any time under Profile > Privacy & Legal > Refund Reviews. See the Privacy Policy for what is shared.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Upload content that is offensive, harmful, or violates the rights of others.
• Attempt to reverse-engineer, decompile, or tamper with the App.
• Share your account credentials with others.
• Use the App to harass, abuse, or harm others.
• Attempt to access other users' data or bypass security measures.

5. User Content

You retain ownership of the videos and data you upload to the App. By uploading content, you grant Fine Apps LLC and its service providers a limited license to host, transmit, process, and analyze it solely for the purpose of providing, securing, and supporting the App's services.

You represent and warrant that you have all rights and permissions necessary to upload and process the content, including appropriate permission from identifiable training partners, spectators, recording owners, gyms, or event organizers where applicable. You may not upload content obtained unlawfully, recorded where recording was prohibited, or submitted in violation of another person's privacy or publicity rights.

6. AI-Generated Content Disclaimer

The App uses OpenAI services to provide training feedback and analysis. Please be aware that:

• AI-generated advice is for informational and educational purposes only.
• AI analysis may not always be accurate or complete.
• AI feedback is not a substitute for professional coaching or medical advice.
• You should always train under proper supervision and consult a qualified instructor.
• We are not liable for injuries or damages resulting from following AI-generated advice.

Certain SmartBJJ features securely send selected information and context to OpenAI for AI processing. By creating an account or signing in through a screen that links these Terms and the Privacy Policy, and by choosing to use the relevant AI features, you agree to the processing described in those documents. You may withdraw permission for future OpenAI processing through Profile > Privacy & Legal > AI Processing. Withdrawal stops future processing. If you later choose to use an AI feature, SmartBJJ will ask you to confirm before processing, and that confirmation records your permission again.

7. Health and Safety Disclaimer

Brazilian Jiu-Jitsu is a physical activity that carries inherent risks of injury. The App is a training tool and does not replace proper instruction, supervision, or medical advice. Always consult with a healthcare provider before starting any new exercise program. Train at your own risk.

8. Intellectual Property

The App, including its design, code, features, and content (excluding user-uploaded content), is owned by Fine Apps LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.

9. Limitation of Liability

To the maximum extent permitted by law, Fine Apps LLC (operating as SmartBJJ) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, personal injury, or loss of profits, arising from your use of the App.

10. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the App ceases immediately. You may delete your account at any time through the App's settings.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App and request renewed acceptance when required. The effective date above identifies the current version.

12. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in Virginia.
